Richard B. Felder/Stephen D. Luftig letter on Breakout Tanks:

On February 4, 2000, Mr. Richard Felder, Associate Administrator, Office of Pipeline Safety, United States Department of Transportation and Mr. Stephen D. Luftig, Director of Emergency and Remedial Response, United States Environmental Protection Agency sent a letter to the Department of Transportation, Office of Pipeline Safety Regional Directors concerning jurisdiction over breakout tanks/ bulk oil storage tanks (containers) at transportation-related and Non-transportation-related facilities.

This agreement clarifies these jurisdictional issues and establishes mutual goals for the Office of Emergency and Remedial Response and the Office of Pipeline Safety. However, the letter does not amend the 1971 MOU between the EPA and DOT or redelegate any responsibilities agreed to under that MOU or previously assigned to DOT or EPA under Executive Order 12777 or any previous Executive Order.

This letter and the attachments which show jurisdictional boundaries in different scenarios can be found on the RCP website at
